Please read these Terms of Service carefully. They set out the basis on which you may use the mobile software application (the "App") and our websites (together with the App, the "Services") offered by RUNEBYTE LTD ("Gighead", "we", "us" or "our"). If you do not accept these Terms of Service, do not use the Services. If you have any questions, contact us at support@gighead.app. We may update these Terms of Service from time to time. Your continued use of the Services after changes become effective means you accept the updated Terms of Service.

1. ABOUT US

1.1 RUNEBYTE LTD is a company registered in England and Wales. These Terms of Service are issued by RUNEBYTE LTD so when we mention Gighead, we, us or our in these Terms of Service, we are referring to RUNEBYTE LTD.

1.2 We provide a platform for viewing, entering, and managing content for live music events (or "gigs"). We are not involved in ticket sales or resales and do not facilitate ticket transactions of any kind.

2. OVERVIEW

2.1 Your access to and use of the Services is subject to your acceptance and compliance with these Terms of Service. You cannot access or use the Services without accepting these Terms of Service and Privacy Policy (which is incorporated into these Terms of Service by this reference).

2.2 You must be 18 years old or older to create an account or use the Services. By using the Services, you represent and warrant that you are at least 18. We may request age verification and may suspend or terminate any account that we reasonably believe is held or used by a person under 18.

3. REGIONAL RIGHTS

3.1 These Terms of Service apply globally, but some rights and obligations vary by region. Nothing in these Terms of Service limits or excludes rights that cannot be limited or excluded under applicable law.

3.2 If you are in the UK or EU, you retain all mandatory consumer protections under applicable local law.

3.3 If you are in the United States, including California, you may have additional consumer and privacy rights under federal or state law.

3.4 If you are in Canada, you retain non-waivable statutory rights under applicable federal and provincial consumer protection laws.

3.5 If local mandatory law does not allow a provision in these Terms of Service to apply as written, that provision applies only to the extent permitted, and the rest of the Terms of Service remain in force.

4. GENERAL SERVICE DESCRIPTION

4.1 These Terms of Service deal with your access to the Services. The Services enable you to view, enter, manage, and share content related to live music events including information about artists, venues, festivals, songs, and related images. We do not sell tickets or facilitate ticket transactions in any way.

4.2 The Services allow you to register an account which is specific to you. To provide you with access to the Services, we must collect, process and store certain data including, at times, your personal data, which we will do in accordance with these Terms of Service and our Privacy Policy.

4.3 The Services enable you to upload images related to music events. You may choose to keep these images private, share them with friends, or make them publicly available to other users. When you make images public, they become visible to all users of the Services.

4.4 The Services allow you to add friends who can view your gig information and, where you have granted access, your images. You control which content is shared with your friends and can modify these sharing settings at any time.

4.5 We may, from time to time, update the Services to provide additional functionality or services to you, or to carry out any maintenance or upgrades to existing functionality.

4.6 Public content may be copied, reshared, indexed, captured, or referenced outside the Services. You should avoid posting sensitive personal information in public content.

5. LIABILITY, DISCLAIMERS, AND SERVICE AVAILABILITY

5.1 Nothing in these Terms of Service excludes or limits our liability where it cannot legally be excluded or limited.

  • personal injury or death resulting from our negligence;
  • fraud; or
  • any matter which it would be unlawful to exclude or restrict.

5.2 To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

  • compatible with any or all of your mobile devices or any software which you may use on your device;
  • available all the time or at any specific time; or
  • completely accurate, complete, secure, or up to date, although we try.

5.3 We are not responsible for third-party content, linked websites, or third-party services, and we do not guarantee the accuracy of user-generated content.

5.4 To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, revenue, business, goodwill, opportunity, or data.

5.5 To the maximum extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or related to the Services or these Terms of Service is limited to the greater of: (a) GBP 100; or (b) the amount you paid us for the Services in the 12 months before the claim arose.

5.6 We are not liable for delay or failure caused by events beyond our reasonable control, including network failures, outages, labor disputes, governmental action, natural disasters, or third-party platform failures.

6. USER CONTENT, REPORTING, MODERATION, AND BLOCKING

6.1 The Services allow you to upload, share, and manage content including text, images, and other materials related to music events ("User Content"). You retain ownership of any intellectual property rights in your User Content.

6.2 When you upload images to the Services, you may choose to keep them private, share them with friends, or make them publicly available. Public images can be viewed by all users of the Services. Images shared with friends can only be viewed by users you have added as friends and to whom you have granted image access.

6.3 The friends feature allows you to connect with other users and share your gig information and images with them. You are responsible for managing your friend connections and privacy settings. We are not responsible for how your friends use or share the content you make available to them.

6.4 Users can report content or accounts directly within the Services. We use automated systems and human moderators to detect and review potential violations. All content that is reported by users is reviewed by a human moderator.

6.5 While we do not pre-screen all content, we reserve the right to review, moderate, remove, restrict, disable access to, or investigate any content or account to maintain safety, legal compliance, and platform integrity.

6.6 We review reports within a reasonable timeframe. We may issue warnings, remove content, limit features, suspend accounts, or permanently terminate accounts for severe or repeated violations.

6.7 We provide user blocking tools. If you block another user, we may prevent that user from interacting with you through supported features. We may also place additional interaction restrictions where required for safety.

7. COMMUNITY GUIDELINES AND PROHIBITED CONTENT

7.1 You may not upload, post, transmit, or otherwise make available content or behavior that is unlawful or harmful, including:

  • harassment, bullying, intimidation, or abusive conduct;
  • hate speech or content promoting discrimination, extremism, or violence;
  • violent threats or incitement to violence;
  • sexually explicit content, sexual exploitation, or non-consensual intimate imagery;
  • content that exploits, sexualizes, endangers, or depicts abuse of minors;
  • impersonation, fraud, deception, or doxxing;
  • spam, scams, malware, or coordinated inauthentic activity;
  • promotion of illegal activity, including unlawful drug or weapon-related activity;
  • copyright infringement or other intellectual property violations; and
  • any other content that violates applicable law.

7.2 You are solely responsible for your conduct and your User Content, and for ensuring you have all necessary rights, permissions, and consents to post that content, including consent from identifiable individuals where required.

7.3 You can use the Services for your own personal use and must not use the Services for any prohibited purpose under these Terms of Service.

8. ACCOUNT, CONTENT LICENSE, AND ENFORCEMENT

8.1 You will need to register an account in order to access certain features of the Services. When registering an account, you will be required to provide your name, mobile number and email address. You agree to provide us with accurate and up-to-date information as requested when registering your account, and you agree to update your details promptly if there are any changes.

8.2 In order to use certain aspects and features of the Services, you must have a compatible mobile device, access to the Internet, mobile messaging and data services. Fees and charges may apply to your use of the Internet or mobile messaging services. You agree that you are responsible for any such fees or charges where these apply.

8.3 You also agree that:

  • you will not interfere or attempt to interfere with the proper functioning of the Services or disrupt the operations or breach the security of the Services;
  • you will not reproduce, duplicate, copy, remove, modify or exploit the Services or their content or its software in any way;
  • you will not use software, devices, or other manual or automated processes to access any portion of the Services, including but not limited to use of any scripts or web crawlers;
  • you will not use the Services in any way that is fraudulent or illegal; and
  • you will not upload or share content that infringes on the intellectual property rights of others.

8.4 The Services and their contents are protected by intellectual property rights which either belong to us or are licensed to us to use. You may not copy or use them without our consent in writing.

8.5 The Gighead word mark and our logo are registered trademarks and must not be used in any way without our express prior written consent.

8.6 By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, publish, distribute, and make available your User Content solely for operating, securing, improving, and promoting the Services. This license ends within a commercially reasonable period after content is deleted from the Services, except where retention is required by law, legitimate safety needs, or technical backup cycles.

8.7 We may suspend or terminate accounts where we reasonably believe there is a violation of these Terms of Service, a safety risk, legal risk, or abuse of the Services. We may act immediately in urgent cases.

8.8 If your account is suspended or terminated, you may contact support@gighead.app to request a review, unless we are legally restricted from providing additional information.

9. COPYRIGHT COMPLAINTS AND REPEAT INFRINGER POLICY

9.1 If you believe content on the Services infringes your copyright or other intellectual property rights, contact support@gighead.app with:

  • a description of the work claimed to be infringed;
  • the specific URL or in-app location of the allegedly infringing content;
  • your name and contact details;
  • a statement that you have a good-faith belief the use is unauthorized; and
  • a statement that the information is accurate and that you are authorized to act.

9.2 Where permitted by law, users may submit a counter-notice if they believe content was removed in error. We may restore content when appropriate.

9.3 We may terminate repeat infringers' accounts in appropriate circumstances.

10. CLOSING YOUR ACCOUNT, THIRD-PARTY SERVICES, AND APP STORES

10.1 These Terms of Service apply from first use until terminated. There is no minimum term.

10.2 You can uninstall the App at any time. Uninstalling does not automatically close your account. To request account closure, contact support@gighead.app.

10.3 The Services may integrate with social networking platforms (such as Facebook), music streaming platforms (such as Spotify) and other third party applications. Your use of any integrated applications will be subject to those third party's terms of service and their privacy policies.

10.4 When you access third party websites or applications from the Services you do so at your own risk. Any third party websites or applications are outside of our control, and we are not responsible for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or applications.

10.5 Sometimes Gighead may request additional permissions related to the settings on your mobile device, such as accessing your camera for image uploads or enabling push notifications in order to carry out certain actions or allow you to enjoy certain features. If you choose not to give us the necessary permissions then you may not be able to access all the features and functions of the Services.

10.6 If you access the Services through Apple App Store or Google Play, you agree to comply with applicable store terms. Apple and Google are not parties to these Terms of Service and are not responsible for maintenance or support of the App.

11. GENERAL

11.1 If you have any complaint about the Services, contact us at support@gighead.app and we will try and resolve it as soon as possible.

11.2 We provide internal complaint handling for moderation and account actions. You may contact support@gighead.app to request review of moderation decisions, subject to legal and safety constraints.

11.3 These Terms of Service are governed by the laws of England and Wales, except where mandatory local law in your country of residence requires otherwise. If local law allows, disputes will be subject to the courts of England and Wales.

11.4 No one other than a party to these Terms of Service has any right to enforce any of these Terms of Service.
